New standards on the import of used machinery, equipment and technological lines

The Prime Minister has just signed the Decision No.18/2019/QD-TTg dated April 19, 2019, on the import of used machinery, equipment and technological lines.

Accordingly, the import of used machinery, equipment and technological lines must comply with the provisions of the law on goods import. Used machinery, equipment and technological lines are not allowed to be imported in the following cases: The exporting countries have announced their elimination due to backwardness, poor quality and causing environmental pollution; Failure to meet the requirements of safety, energy saving, environmental protection as prescribed by law. At the same time, it is only allowed to import used machinery, equipment, technology lines directly serving the production activities of enterprises in Vietnam.

Used machinery and equipment are allowed to be imported when the equipment’s age does not exceed 10 years and must be manufactured in accordance with the provisions of national regulations (QCVN) on safety and energy efficiency. quality and environmental protection. In the absence of QCVN related to imported machinery and equipment, imported machinery and equipment must be manufactured in accordance with the technical standards of Vietnam’s national standards (TCVN) or national standards. of one of the G7 countries, South Korea on safety, energy saving environment.

Capacity (calculated according to the number of products produced by the technological chain in a unit of time) or the remaining efficiency must reach 85% or more of the designed capacity or efficiency.

In addition, used lines and technologies are allowed to be imported when meeting other criteria such as: Compliance with QCVN regulations on safety, energy saving and environmental protection; Consumption of raw materials and energy does not exceed 15% of the design; Technologies of technological lines that are not on the List of technologies banned from transfer and the List of technologies restricted from transfer specified in the Government’s Decree No. 76/2018/ND-CP of May 15, 2018; Technology of technological lines must be used in at least 3 production establishments in countries under the Organization for Economic Cooperation and Development (OEDC), etc.

In case the enterprise is conducting production in Vietnam, in order to ensure the maintenance of production activities, there is a need to import used machinery and equipment with equipment age of more than 10 years but capacity or efficiency. the remaining capacity of machinery and equipment still reaches 85% of the design capacity or efficiency, and the consumption of raw materials, materials and energy of machinery and equipment does not exceed 15% compared to the design, business. enterprises submit 01 set of dossier requesting the import permission and send it to the Ministry of Science and Technology for consideration and settlement.

In addition to the import documents required by the Law on Customs, enterprises must submit the Ministry of Science and Technology’s written approval of the import of used machinery and equipment to the customs office where the customs declaration is registered to carry out customs clearance according to regulations.

The decision takes effect from June 15, 2019.
